1 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Daily Bazaar website, mobile application, and all related services (collectively, the "Platform") operated by Daily Bazaar Private Limited ("Company", "we", "us", or "our"), a company incorporated under the laws of India.

By browsing, placing an order, or otherwise using the Platform — whether or not you create an account — you confirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and our Refund & Return Policy.

If you do not agree to these Terms, please discontinue use of the Platform immediately. Daily Bazaar reserves the right to update these Terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms.

2 No-Auth Guest Checkout — Your Privacy by Design

🔒 Privacy-First Model

Daily Bazaar operates a No-Auth (No-Authentication) Guest Checkout model. This means you can browse, shop, and complete your entire order without creating an account, logging in, or providing a password. We believe your data is yours, and we design our systems accordingly.

What We Collect at Checkout

  • Delivery Address — required to fulfill your order.
  • Mobile Number — for delivery updates and OTP confirmation.
  • Email Address (optional) — for digital receipt and order status.
  • Payment Info — processed via PCI-DSS compliant gateways. We never store your card details.

What We Do NOT Do

  • We do not require account registration to place an order.
  • We do not sell, rent, or share your personal data with third-party advertisers.
  • We do not build persistent consumer profiles without your consent.
  • We do not store payment card numbers on our servers.

Guest Order Tracking

After placing a guest order, you will receive an Order ID via SMS and/or email. Use this Order ID to track your delivery, raise support tickets, or request refunds. Retain this ID — it is your only reference for the order in our system. Daily Bazaar is not responsible for orders that cannot be tracked due to an invalid or lost Order ID.

3 Placing Orders

When you place an order on Daily Bazaar, you are making an offer to purchase goods at the listed price. A binding contract is formed only when we confirm your order and dispatch it. We reserve the right to refuse or cancel any order at our discretion, including orders where pricing errors, product unavailability, or suspected fraudulent activity is detected.

  • i Order Confirmation: You will receive an SMS and/or email with your Order ID within minutes of payment confirmation.
  • i Accuracy of Information: You are responsible for ensuring that the delivery address, contact number, and item selections are accurate before submitting your order.
  • i Age Restriction: By placing an order, you confirm you are at least 18 years of age, or have parental/guardian consent.
  • i Product Availability: All products are subject to availability. If an item becomes unavailable after order placement, we will notify you and offer a refund or suitable substitute.

4 Order Cancellation – The 2-Day (48-Hour) Rule

You may cancel your order free of charge within 48 hours (2 days) of placing it, provided the order has not yet been dispatched. Once the 48-hour window has passed or the order has entered active processing or dispatch — whichever comes first — the order is locked and cannot be cancelled.

Cancellation allowed. Full refund to original payment method within 2–7 business days.

Order Enters Processing / Dispatch

⚠️ Order is locked. Even if within 48 hours, a dispatched order cannot be cancelled. Contact support immediately.

After 48 Hours (No Dispatch)

Cancellation not permitted. The order is in fulfilment and cannot be reversed. Refer to Refund Policy for post-delivery options.

How to Cancel an Order

  • 1.Locate your Order ID from confirmation SMS/email.
  • 2.Visit "Track Order" on the app or website.
  • 3.Click "Cancel Order" if the option is still available.
  • 4.Or contact support at support dailybazaar@gmail.com.

Cancellation by Daily Bazaar

  • Product stock exhausted after order placement.
  • Payment not received or reversed by bank.
  • Delivery address outside serviceable zone.
  • Suspected fraudulent or duplicate order.

Daily Bazaar offers 10-minute hyper-local delivery for groceries and essentials from our dark stores. For products sourced from our extended fulfilment network or for areas where dark store coverage is limited, the following shipping timelines apply:

Disclaimer: Delivery timelines may be affected by natural disasters, public holidays, courier strikes, government restrictions, or circumstances beyond our control (force majeure events). In such cases, Daily Bazaar will notify you proactively and offer cancellation with a full refund.

6 Pricing, Taxes & Payments

All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes (GST) unless stated otherwise. Daily Bazaar reserves the right to change prices at any time without prior notice; however, the price at the time of your order confirmation is final for that specific transaction.

  • Payment Methods Accepted: UPI, Credit/Debit Cards (Visa, Mastercard, RuPay), Net Banking, Wallets (Paytm, PhonePe, Amazon Pay), and Cash on Delivery (COD) where available.
  • Payment Security: All digital payments are processed through PCI-DSS Level 1 compliant payment gateways. Daily Bazaar does not store card details on its servers.
  • Coupon & Discount Codes: Valid only at the time of application. Cannot be applied retroactively to completed orders. Misuse or abuse of promotional codes may result in order cancellation.
  • Failed Transactions: If a payment is deducted but no order confirmation is received within 30 minutes, please contact support. Unconfirmed payments are automatically reversed within 5–7 business days.

7 User Conduct & Prohibited Activities

You agree not to use the Platform to engage in any of the following prohibited activities:

Submitting false, fraudulent, or misleading orders or information.
Using bots, scrapers, or automated tools to access the Platform.
Attempting to reverse-engineer, hack, or gain unauthorized access.
Abuse of refund or cancellation policies (repeat fraudulent claims).
Harassing, threatening, or abusing delivery personnel or support staff.
Impersonating another person or misrepresenting your identity.

Violation of these terms may result in order blacklisting, IP blocking, or legal action under applicable Indian law including the IT Act, 2000.

8 Intellectual Property

All content on the Daily Bazaar Platform — including but not limited to the "Daily Bazaar" name and logo, product photographs, website design, user interface, text, graphics, and software — is the exclusive property of Daily Bazaar Private Limited or its licensors, and is protected by Indian and international copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on this Platform without our prior written consent.

9 Limitation of Liability

To the maximum extent permitted by applicable Indian law, Daily Bazaar and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of — or inability to use — the Platform or any products purchased through it.

Our aggregate liability for any claim arising from a specific order shall not exceed the total amount paid by you for that specific order. This limitation applies regardless of the form of action, whether in contract, tort, negligence, or otherwise.

10 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

Before initiating formal legal proceedings, both parties agree to attempt good-faith resolution through direct communication. If unresolved within 30 days, disputes may be submitted to arbitration under the Arbitration and Conciliation Act, 1996 of India, with a single arbitrator appointed by mutual agreement.

Consumer Rights: Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act, 2019 of India or any other applicable consumer protection legislation.
